377 Indictable and summary offences
(1)
An offence against this Act is an indictable offence, and a crime, if the maximum penalty for the offence is—
(a)
500 penalty units or more; or
(b)
5 years imprisonment or more.
(3)
Otherwise, an offence against this Act is a summary offence.
