Compensation for entry or temporary occupation
25 Compensation for entry or temporary occupation
A person interested in land that is entered or temporarily occupied pursuant to this Part may, at any time before the expiration of three months from the day on which the Board, or any person authorised by the Board, was last in occupation of, or upon, the land, by notice in writing served upon the
Board, claim compensation.
If after the expiration of three months from the day on which a notice was served under subsection (1) of this section, the Board and the claimant are not agreed upon the amount of compensation that should be paid, either the Board or the claimant may refer the matter to the Court for determination.
The Court shall, upon the reference of any such matter, determine the amount of compensation that should be paid by the Board, and order the payment of that amount to the claimant.
The compensation shall be determined in accordance with the appropriate provisions of the Land Acquisition
Act 1969.
