70DA Audit of program
A tenement holder must, at the direction of the Minister, do 1 or both of the following:
carry out specified tests, environmental monitoring or other investigations (a program audit) relating to any authorised operations carried out under the relevant mineral tenement;
comply with the requirements or outcomes of a program audit to the satisfaction of the Minister.
The Minister may, in acting under subsection (1), provide directions about 1 or more of the following:
the independence, qualifications or experience of a person who will carry out a program audit;
the period within which a program audit must be completed;
the provision of a report or reports to the Minister.
A program audit must be carried out in accordance with any requirements prescribed by the regulations.
Without limiting subsection (1)(b), the Minister may rely on any information provided in a report under this section for the purposes of requiring a review of a program under section 70C.
Without limiting subsection (2)(a), the Minister may require that the audit be conducted by a person approved by the
Minister.
Any cost associated with a requirement under this section will be borne by the tenement holder.
