Non-compliance may be excused by the Tribunal

Current

(1)

The

Tribunal may, on the application of any person, excuse that person from the consequences of inadvertent non‑compliance with a provision of this Act.

(2)

If the Tribunal acts under subsection (1), it may—

(a)

make consequential orders protecting the interests of a person affected by the contravention; and

(b)

make any other order that the justice of the case may require.

(3)

An application may not be made under this section after proceedings for an offence relating to the non‑compliance have been commenced.
