Dissolution of WCT
52 Dissolution of WCT
The Governor may, when he or she thinks that it is appropriate to do so, by proclamation, dissolve WCT.
When a proclamation is made under subclause (1)—
subject to subclause (3), any member of WCT (being either a presidential member or a conciliation officer) holding office under the repealed Act at the time of the making of the proclamation will cease to hold that office and any contract, agreement or arrangement relating to that office held by the member is terminated by force of this paragraph at the same time (and no right of action will arise against the Minister or the State on account of that termination); and
any proceedings before the WCT will be dealt with in accordance with provisions made by the regulations.
A member of WCT who is a Judge of the Industrial Relations Court of
South Australia will continue as a member of SAET under the provisions of the
South Australian Employment Tribunal
Act 2014.
