A person who is dissatisfied with a decision of the Commissioner for Consumer Affairs, or a direction of an authorised officer under section 12, may apply to the Tribunal under section 34 of the South Australian Civil and Administrative Tribunal Act 2013 for review of the decision or direction.
Subject to subsection (3)(b), an application for review must be made within 28 days of the making of the relevant decision or direction.
Subject to section 5—
the Commissioner for Consumer Affairs or authorised officer (as the case requires) must, if so required by the person seeking review under subsection (1), state in writing the reasons for the decision or direction in relation to which the review is sought;
and
if the reasons of the Commissioner for Consumer Affairs or authorised officer are not given in writing at the time of the decision or direction (as the case requires) and the person (within 1 month of the decision or the direction) requires the Commissioner or authorised officer to state the reasons in writing, the time for making an application for review runs from the time at which the person receives the written statement of those reasons.
