Where an object may be retained under subsection (1), it shall be retained in such manner and in such custody as the Director may approve.
Where any object has been seized from any person under this Act and, within 3 months of its seizure, no proceedings have been instituted for such an offence as is referred to in subsection (1), a court of petty sessions, on the application of that person, may direct it to be returned to him and, on the making of that direction, the authority under that subsection to retain the object ceases.
Where an object is seized under section 9(3), nothing in this section shall be construed as prejudicing or affecting the rights of the owner of the object or any other person having property therein.
