46A References in laws of the State to Australian citizens
Subject to subsection (2), a reference in a law of the State – to an Australian citizen, shall be read as a reference to a person who is an Australian citizen within the meaning of the Commonwealth Act; and to an alien, shall be read as a reference to a person who is not an Australian citizen within the meaning of the Commonwealth Act.
Where a rule of law applies to or in relation to, or has effect with respect to an alien, that rule of law applies to or in relation to, or has effect with respect to, a person who is not an Australian citizen within the meaning of the Commonwealth Act.
In this section – Commonwealth Act means the Australian Citizenship Act 1948 of the Commonwealth; law of the State means – an Act and any other law in force in the State; an instrument (including regulations) having effect by virtue of such an Act; and an instrument having effect by virtue of an instrument to which paragraph (b) of this definition relates.
