233 Offences by employers
If an employee or agent commits an offence under this Act, the employer or the principal of the agent is taken to have committed the same offence.
Despite subsection (1), it is a defence in proceedings against an employer or principal for such an offence if it is proved that the employer or principal could not, despite taking all reasonable precautions and exercising all due diligence, have known of or prevented the commission of the offence.
An employer or principal may be proceeded against and convicted for an offence pursuant to this section whether or not the employee or agent has been proceeded against or convicted for the offence.
