63 Powers of Board
For the purposes of this Act, the Board may – by summons signed by the secretary of the Board, require any person to attend before the Board; and require any person to give oral or written answers to any questions relating to any matter before the Board; and by summons signed by the secretary of the Board, require any person to produce any document in the person’s possession or control relating to any matter before the Board; and examine a witness on oath or affirmation which may be administered by any member of the Board; and require any information given to the Board to be verified by statutory declaration.
A person is guilty of an offence if the person – having been duly served with a summons to attend before the Board, neglects or fails to attend, without reasonable excuse, in answer to the summons; or wilfully insults the Board or a member of the Board; or misbehaves himself or herself before the Board; or interrupts the proceedings of the Board; or having been called or examined as a witness before the Board, refuses to be sworn or to affirm, refuses to answer any question that the person would be compellable to answer in a court or refuses to produce a document specified in a summons served on the person. Fine not exceeding 10 penalty units or imprisonment for a term not exceeding 6 months.
For the purposes of any business before it, the Board may – appoint a member of the Board to make an investigation or inquiry and may consider the report of that investigation or inquiry made by the member; and consider the report of an investigation or inquiry made by any other person who it is satisfied is competent to make that investigation or inquiry; and rely on the knowledge of a member of the Board, however that knowledge is gained.
