53 Compliance with Compulsory Schooling Order
The school student named in a Compulsory Schooling Order and his or her parent named in the Order must comply with it. In relation to a contravention by a parent named in the Compulsory Schooling Order, a fine not exceeding 15 penalty units and a further fine not exceeding 2 penalty units for each day during which the offence continues.
In proceedings for an offence under subsection (1), a document purporting to be a Compulsory Schooling Order and purporting to be signed by the Principal Officer, Non-attendance or his or her delegate is taken to be evidence, until the contrary is shown – that the document is a duly made Compulsory Schooling Order; and of the facts specified in the document; and that a copy of the document has been provided to the defendant.
If a court finds a parent guilty of an offence under subsection (1), the court, instead of or in addition to imposing a fine, may impose a community service order within the meaning of the Sentencing Act 1997.
