The Council, on the recommendation of a Committee, may appoint– fire permit officers in respect of the State forest within the Committee's Fire Management Area; and fire permit officers in respect of any reserved land as defined in the Nature Conservation Act 2002 within the Committee's Fire Management Area; and fire permit officers in respect of other land within the Committee's Fire Management Area.
A person appointed under subsection (1)(a) is to be nominated for the appointment by the chief executive officer of the Forestry corporation.
A person appointed under subsection (1)(b) is to be nominated for the appointment by the Secretary of the responsible Department in relation to the National Parks and Reserves Management Act 2002.
A person appointed under subsection (1)(c) is to be – a member of a brigade that is based in the Fire Management Area; or a person who has skills, qualifications or experience that the Council considers would enable that person to carry out the duties of a fire permit officer competently.
A person appointed by the Commission under this section, and holding office immediately before the commencement day, is taken to have been appointed by the Council under this section on the same terms and conditions.
In this section – commencement day means the day on which the Fire Service Amendment Act 2012 commences.
