In this section – absent, in relation to the Homes Tasmania CEO, means the Homes Tasmania CEO – is absent from duty; or is absent from Australia; or is otherwise unable to perform and exercise the functions and powers of the office of Homes Tasmania CEO; or has died, resigned or been removed from office and a new Homes Tasmania CEO has not been appointed.

A person, other than the Homes Tasmania Board chair, may be appointed to act as the Homes Tasmania CEO during any or every period during which the Homes Tasmania CEO is absent.

Except as otherwise provided under this section, this Act applies to the appointment of a person under subsection (2) as if the appointment were the appointment of the Homes Tasmania CEO.
