Protection from personal liability

Current

In this section – official means – the Secretary; or a person acting under the direction of the Secretary; or a member of staff of the Department; or an inspector.

An official does not incur any personal liability in respect of any act done or omitted in good faith – in the performance or exercise, or the purported performance or exercise, of any function or power under this Act; or in the administration or execution, or purported administration or execution, of this Act.

A civil liability that would, but for this section, attach to an official attaches to the Crown.
