Integrity Commission Act 2009

On receipt of a report under section 57(1) or a recommendation under section 57(3), the Board may make a determination referred to in subsection (2) in relation to the subject matter of the report or recommendation.

The Board may – dismiss the complaint; or refer the report of the investigation and any information obtained in the conduct of the investigation to – the principal officer of the relevant public authority for action; or an appropriate integrity entity for action; or an appropriate Parliamentary integrity entity; or the Commissioner of Police or DPP for action; or the responsible Minister; or a person who the Board considers appropriate; or recommend to the Premier that a commission of inquiry be established under the Commissions of Inquiry Act 1995 in relation to the matter; or require that a further investigation be conducted by the investigator; or determine that an inquiry be undertaken by an Integrity Tribunal under Part 7.

In referring a matter to a person under subsection (2)(b), the Board may make a recommendation as to appropriate action that it considers should be taken in relation to the matter.

A person to whom a report is referred under subsection (2)(b) must notify the Board of any action taken in relation to the report within such time and in such manner as the Board may require.
