13 Annual reports of council
Within 3 months after the end of a financial year, the council must prepare a report in respect of the work and activities of the council in that financial year and give the report to the Minister.
A report under subsection (1) must include the following in respect of the relevant financial year:the number of complaints – received by, or referred to, the council; dismissed under section 35; referred to the relevant head of jurisdiction under section 37; dismissed under section 41; substantiated under section 42; the number of commissions established under this Act; if a complaint is dismissed by the council under section 35, or referred by the council to the relevant head of jurisdiction under section 37, a summary of the grounds for that dismissal or referral; a description, which may include statistics, of any patterns in the nature and scope of complaints made to or dealt with by the council.
The report under subsection (1) may include – recommendations for changes, or any other matter that the council considers relevant, to one or more of the following:this Act; a function or power of the council, or a commission, under this Act; related administrative matters arising from the performance of the functions, or the exercise of the powers, of the council; and an analysis of the nature and scope of complaints received, investigated, referred, dismissed or substantiated under this Act.
The report under subsection (1) must not identify the relevant judicial officer in respect of a complaint that has been made under this Act, unless the person – has been identified in the public domain, and is widely recognised, in connection with the person’s behaviour that was the basis of the complaint; or has been convicted of an offence connected with the complaint.
The Minister must, as soon as practicable after receiving a report under subsection (1), table the report in each House of Parliament.
