A question before the council must be decided – in accordance with the opinion of a majority of the council members; or if the council is equally divided, in accordance with the opinion of the head of the council.

If, in relation to a question before the council, council members are not unanimous in opinion, a council member may require the record of the council to reflect the different opinions of the council members on that question.

In any examination under this Part, the council may initiate such inquiries into the subject matter of the complaint as the council considers appropriate.

An examination under this Part and any inquiries under this Part must, as far as practicable, be held in private.

For the avoidance of doubt, subsection (4) does not apply to a hearing held by the council in respect of the complaint if the council decides under section 39 that the hearing is to be held in public.
