Marine Farming Planning Act 1995

The Minister may cancel a lease if – satisfied that a lease area or part of a lease area is not being sufficiently or effectively farmed; or the lessee fails to obtain a marine farming licence or ceases to hold a marine farming licence in respect of a lease area or part of a lease area.

Before cancelling a lease under subsection (1), the Minister must – inform the lessee of the intention to cancel the lease; and invite the lessee to make any written submission; and consider that submission.
