94 Recommendation of application for transfer
The Director is to consider an application for the transfer of a lease.
The Director may only recommend that the Minister grant an application for the transfer of a lease if satisfied that the person to whom the applicant proposes to transfer the lease– intends to mine; and intends to comply with this Act; and has an appropriate mining plan; and is likely to have sufficient financial and technical resources to carry out the mining plan; and has provided the Director with sufficient information relating to the likely impact on the environment; and has provided a security deposit.
