Monetary Penalties Enforcement Act 2005

Subject to subsection (2), an enforcement debtor may apply to the Director for the suspension of an enforcement order.

Unless otherwise approved by the Director – an application is to be made within the earlier of the following:14 days after the debtor becomes aware of the existence of the order;6 months after the service of the order; and an application may only be made once in respect of a particular enforcement order.

An application is to – be in an approved form; and set out in full the reasons for the application.

The Director may consider an application in the absence of the applicant.
