29 Sales of certain substances by correspondence
Where a person (in this subsection referred to as "the seller") sells or supplies a hazardous poison to another person (in this subsection referred to as "the buyer") as the result of a written communication received by the seller from the buyer, the seller must preserve that communication for a period of at least 5 years after the day on which it is received by him, and shall enter in the poisons book a memorandum specifying– the date of that communication; from whom that communication was sent; and the quantity and particulars of the hazardous poison ordered in that communication. Fine not exceeding 20 penalty units.
A person (in this subsection referred to as "the seller") must not, unless the Secretary approves otherwise, sell or supply to another person (in this subsection referred to as "the buyer") a hazardous poison as the result of written communication received by the seller from the buyer, unless the written communication is signed by the buyer. Fine not exceeding 10 penalty units.
For the purposes of this section, a signature includes an electronic signature.
