Private Forests Act 1994

In this section, absent, in relation to a director referred to in section 8(1)(a), (b) or (c), means – absent from duty; or absent from Australia; or otherwise unable to perform the functions of the office of director.

The Minister may appoint a person to act as a director referred to in section 8(1)(a), (b) or (c) if the director referred to in section 8(1)(a), (b) or (c) is absent.

While a person appointed under subsection (2) is acting as a director – that person is taken to be a director; and this Act applies to that person as if he or she were a director.

The appointment of a person to act as a director terminates when the absent director resumes the performance of his or her functions as director.
