Another law of this jurisdiction may provide that a provision mentioned in subrule (2) does not apply to the driver of a breakdown vehicle while – the driver is engaged in repairing a disabled vehicle or is assisting a person to gain access to a vehicle in which the person has locked his or her vehicle access key; and the driver is unable to comply with the provision; and the breakdown vehicle is displaying a flashing light; and the driver is acting safely. For subrule (1), the provisions are as follows:rule 137 (Keeping off a dividing strip); rule 138 (Keeping off a painted island); rule 147 (Moving from one marked lane to another marked lane across a continuous line separating the lanes); rule 197 (Stopping on a path, dividing strip, nature strip, painted island or traffic island); rule 288(1) (Driving on a path); rule 289 (Driving on a nature strip); rule 290 (Driving on a traffic island).

In this rule – breakdown vehicle means any vehicle driven by a person who is – a breakdown worker; and driving the vehicle in the course of his or her duties as a breakdown worker;

breakdown worker means a person who is a breakdown worker for this rule under another law of this jurisdiction. See clause 2 of Division 1 of Part 2 of Schedule 6 for jurisdictional definition.
