32 Reinstatement of buildings

If a building on the site is damaged or destroyed, a scheme for reinstating the building in whole or in part may be approved under this section.

A reinstatement scheme referred to in subsection (1) may be approved – by agreement in writing between all interested parties; or by order of the Supreme Court made on application by an interested party.

A reinstatement scheme may – direct how insurance money is to be applied; and direct payment by the body corporate or any one or more owners of lots; and direct changes to the plan; and require the body corporate to compensate the owners of lots prejudiced by changes to the plan; and deal with incidental or ancillary matters.

The interested parties are – the body corporate; and the insurer; and the owners and registered mortgagees of lots affected by the scheme; and the council in the municipal area of which the relevant land is situated; and all other persons who appear from the Register to have an interest in the scheme.
