53 Corridor manager may determine restricted or prohibited access areas
A corridor manager in relation to a corridor may, if authorised to do so by the Minister, by notice, designate an area of land within the corridor to be, on and from a date specified in the notice – a prohibited access area; or a restricted access area.
A corridor manager may, in a notice under subsection (1) in relation to an area of land, specify any or all of the following:the classes of persons who may enter and remain on the area of land; the purposes for which persons may enter and remain on the area of land; activities that may not be carried out on the area of land; the conditions on which a person may enter and remain on the area of land; that a person may only enter and remain on the area of land, or carry out an activity on the land, or both, if the person holds a permission granted under this section (a use permission) so authorising the person; the conditions to which a use permission issued in accordance with the notice is to be subject.
A corridor manager may, in accordance with a notice under subsection (1) and the regulations, if any, in relation to use permissions – grant or refuse to grant a use permission; and require the payment of a prescribed fee for the grant of a use permission; and specify the period for which a use permission remains in force; and cancel a use permission.
A use permission is cancelled if the person who granted the permission ceases to be a corridor manager in relation to the corridor.
A person must not – enter or remain in an area of land to which a notice under subsection (1) relates; or carry out an activity on an area of land to which a notice under subsection (1) relates – in contravention of the requirements of the notice or the conditions of a use permission, if any, granted to the person. Fine not exceeding 20 penalty units.
The regulations may prescribe – the purposes for which an area of land may be specified in a notice under subsection (1); and the functions and powers of the corridor manager in relation to an area of land specified in a notice under subsection (1); and provisions in respect of use permissions.
