68 Consent to be a group member not required

Subject to subsection (2), the consent of a person to be a group member is not required.

None of the following is a group member in representative proceedings unless the person gives consent in writing to being so:the Commonwealth, a State or a Territory; a Minister of the Commonwealth, a State or a Territory; a body corporate established for a public purpose by a law of the Commonwealth, a State or a Territory, other than an incorporated company or incorporated association; an officer of the Commonwealth, a State or a Territory, in his or her capacity as an officer.
