Notice to use affidavit or deposition at trial

An affidavit or deposition filed or made before issue is joined in a proceeding is not to be received at the hearing or trial, unless –

the special leave of the Court or a judge is obtained; or not later than 14 days after issue is joined, the party intending to use the affidavit or deposition gives notice to the opposite party of the intention to have it received.
