6 Minimum service level as condition on wheelchair-accessible taxi licence
The Commission must impose on a wheelchair-accessible taxi licence a condition requiring the vehicle to which the licence relates to be used to undertake a minimum of 30 hirings that involve carrying a wheelchair passenger in each calendar month.
The Commission may impose a condition on a wheelchair-accessible taxi licence requiring the vehicle to which the licence relates to be used to undertake a specific number of hirings that involve carrying a wheelchair passenger, in each calendar month, in addition to the minimum number specified in subregulation (1).
Despite subregulation (1), the holder of a wheelchair-accessible taxi licence need not comply with a condition imposed under that subregulation in a calendar month if the holder of the licence can demonstrate to the satisfaction of the Commission that – the vehicle to which the licence relates is, or was, unregistered for a significant proportion of the calendar month; or the vehicle to which the licence relates is, or was, not in use for a significant proportion of the calendar month; or the number of hirings of the type required by the condition were not available to the operator of the vehicle to which the licence relates during the calendar month.
