42 Removal of appeals into Supreme Court

An objection standing in a court list under section 38 may be summarily removed into the Supreme Court by order of the Supreme Court or a judge, if it appears to the Supreme Court or judge that the objection raises a point of principle of general importance.

An order under this section may be made on such terms as to costs or otherwise as the Supreme Court or judge thinks fit.

When an objection is removed into the Supreme Court under this section, it is to be dealt with in all respects as if it were included in a Supreme Court list under section 41.
