12 Dismissing application for leave
The Court must dismiss an application made under section 11 for leave to institute proceedings if it considers – the affidavit does not substantially comply with section 11(3); or the proceedings are vexatious proceedings.
The application may be dismissed even if the applicant does not appear at the hearing of the application.
