The report and consent of the relevant council must be obtained to an application for a building permit that requires—
(a)
the installation or alteration of a septic tank system; or
(b)
the construction of a building over an existing septic tank system.
(2)
The report and consent of the relevant council need not be obtained to an application for a building permit referred to in subregulation (1) if a permit for the construction, installation or alteration of the septic tank system that is relevant to the application has been issued under section 53M(5) of the Environment Protection Act 1970.
