23 Application for accreditation
S. 23(1) amended by No. 34/2023 s. 127(Sch. 1 item 1.7(a)).
An operator of a bus service may apply to Safe Transport Victoria for accreditation to operate that bus service.
An application under subsection (1) must—

be made in the manner and form determined by Safe Transport Victoria; and
be accompanied by—
the application fee; and
evidence, as required by the regulations, that each relevant person in relation to the applicant satisfies the requirements for accreditation; and
any other thing that is required by the regulations; and
in the case of an application by a person that is not a natural person, nominate a relevant person as the responsible person in relation to the applicant.

Safe Transport Victoria may require any one or more of the following from the applicant in relation to the application—

to do a thing specified by Safe Transport Victoria that Safe Transport Victoria reasonably requires in order to assess the application;
to verify, by a statutory declaration, any statement made or information supplied for the purposes of the application;
to give further information for the purposes of the application.
The application, and any further information given by the applicant under subsection (3), must be—
signed in accordance with subsection (5); and
declared by each signatory to be true and correct.
The application must be signed—
if the applicant is a body corporate—
being a company within the meaning of the Corporations Act, in accordance with section 127 of that Act; or
in any other case, by each director, or each member of the committee of management, of the body corporate; or
if the applicant is an unincorporated association or body, by each member of the committee of management of the association or body; or
if the applicant is a partnership, by each partner; or
if the applicant is a natural person, by that person.
In addition, each signatory referred to in subsection (5) must declare that they are not a person who, under Part 2D.6 of the Corporations Act, is disqualified from managing corporations.

In the case of an application by a person that is not a natural person, Safe Transport Victoria is entitled to communicate with the relevant person nominated by the applicant under subsection (2)(c).
