Cemeteries and Crematoria Act 2003

Without limiting section 27 of the Interpretation of Legislation Act 1984, the Governor in Council, by order published in the Government Gazette, may revoke cemetery trust rules.

An order under subsection (1)—

may revoke cemetery trust rules in whole or in part; and

takes effect on the day it is published in the Government Gazette.

If cemetery trust rules are wholly revoked by an order under subsection (1), the model rules apply to the public cemetery for which the cemetery trust is responsible and in respect of which the order is made from the date that the order takes effect.
