39 Power to fix fees and charges for services
A cemetery trust, from time to time, may fix fees and charges or a scale of fees and charges for its services.
In fixing fees and charges under this section, a cemetery trust must have regard to—
the costs of operating and managing the public cemetery; and

the fees and charges guidelines, if any; and
the need to provide for the maintenance of the public cemetery in perpetuity.
A cemetery trust may fix different fees and charges for different cases or classes of cases.

Fees and charges fixed by a cemetery trust under this section must be approved by the Secretary under section 40, unless they are exempt under section 40A.
