54 Limits on power to delegate

S. 54(1) amended by No. 9/2020 s. 390(Sch. 1 item 13.3).

(1)

Despite anything to the contrary in the Local Government Act 2020, a municipal council is not authorised under that Act to delegate a power or function set out in paragraphs (a), (b), (c), (d), (e) or (g) of section 15(1).

(2)

Despite section 15(2), a municipal council is not authorised to delegate its power or function to approve an application for a lift and re-position procedure to any person other than—

(a)

if a delegated committee of the kind referred to in the Local Government Act 2020 is established under section 63 of that Act and any functions, duties or powers of a municipal council under this Act have been delegated to that delegated committee under the Local Government Act 2020, the members of that delegated committee; or

(b)

a person approved by the Secretary for the purposes of this section.
