Certain other immunities and privileges abrogated
124ZI Certain other immunities and privileges abrogated
If the Chief Commissioner, or another member of Victoria Police personnel, is directed, required or requested under this Division to give any answer, document or information to the IBAC—
that person is not entitled to assert public interest immunity, legal professional privilege or client legal privilege in response to that direction, requirement or request; and
that immunity and those privileges are each abrogated to the extent of that direction, requirement or request; and
every obligation on that person to maintain secrecy, or any other restriction on the disclosure of information, imposed by or under an Act or rule of law—
is overridden; and
does not oblige that person not to comply with the direction, requirement or request.
A member of Victoria Police personnel is not subject to any criminal, civil, administrative or disciplinary proceeding or action only because the member has not maintained secrecy or complied with a restriction on the disclosure of information in the circumstances referred to in subsection (1).
This section does not apply to information, documents and answers that are subject to Cabinet confidentiality.
