It is not a defence to a prosecution or other legal proceeding under this Act which relates to any regulated food purchased for analysis under section 49 to prove that the part of the sample of the regulated food retained for future comparison has from spontaneous natural causes deteriorated, perished or undergone a material change in its constitution.
