162 Recommendations by Authority

(1)

This regulation applies if the Authority considers that a ground exists for a corresponding Authority to do any of the following (the proposed action)—

(a)

revoke or amend a corresponding determination that is not a corresponding administrative determination;

(b)

revoke or amend a corresponding administrative determination;

(c)

revoke or amend a corresponding approval or a corresponding exemption;

(d)

revoke, suspend or amend a corresponding dangerous goods driver licence or a corresponding dangerous goods vehicle licence.

(2)

The Authority may recommend, in writing, that the corresponding Authority take the proposed action.

(3)

The Authority must provide written reasons to the corresponding Authority for the recommendation.

(4)

If the recommendation is about a determination (except an administrative determination), approval or exemption that has effect in one or more other participating jurisdictions, the Authority must also refer the recommendation to CAP.
