2.6.54E Institute may decide that particulars be removed from or excluded from the Register of Disciplinary Action
S. 2.6.54E inserted by No. 19/2014 s. 28.
The Institute, on the application of a registered teacher or a former registered teacher, may decide that all or any of the particulars to be contained in the Register in respect of that person are not to be initially recorded in the Register or are to be removed from the Register if the Institute is satisfied that—
the exclusion of the particular is necessary to avoid endangering the physical safety of a person; and
there is no overriding public interest for the particular to be included or to remain in the Register.
The Institute, on its own initiative, may decide to remove particulars from the Register that relate to the cautioning or reprimanding of a registered teacher if the Institute considers that it is no longer appropriate or in the public interest for the particulars to remain in the Register.
S. 2.6.54E(3) inserted by No. 25/2026 s. 14.
The Institute, on its own initiative, may decline to record in the Register particulars relating to the imposition of an interim suspension on a registered teacher under section 2.6.28 if—
the teacher has an impairment and the grounds on which the Institute believes the teacher poses an unacceptable risk of harm to children under section 2.6.28(1)(a) relate to that impairment; and
the Institute is satisfied that it is—
not appropriate for the particulars to be recorded in the Register; or
not in the public interest for the particulars to be recorded in the Register.
S. 2.6.54E(4) inserted by No. 25/2026 s. 14.
The Institute, on its own initiative, may remove particulars from the Register relating to the imposition of an interim suspension on a registered teacher under section 2.6.28 if—
the teacher has an impairment and the grounds on which the Institute believes the teacher poses an unacceptable risk of harm to children under section 2.6.28(1)(a) relate to that impairment; and
the Institute is satisfied that it is—
not appropriate for the particulars to be recorded in the Register; or
not in the public interest for the particulars to be recorded in the Register.
