3.1.10J Variation of TAFE institute response

(1)
A TAFE institute response may be varied at any time by agreement between the board of the TAFE institute and the Minister.
(2)
If the board of a TAFE institute and the Minister fail to agree to a proposed variation to a TAFE institute response within 28 days after the variation is proposed, the Minister may—
(a)
vary the TAFE institute response; or
(b)
refuse to vary the TAFE institute response.
(3)
The Minister must give written notice of a decision under subsection (2) to the board of the TAFE institute.
