43 Preliminary scrutiny of declarations under section 108
For the purposes of section 111(2) of the Act, the election manager must conduct preliminary scrutiny of a declaration in relation to a provisional vote cast under section 108(2) of the Act in accordance with this regulation.
A ballot-paper marked by a voter under section 108 of the Act must be accepted for further scrutiny if the election manager is satisfied that—
the voter is entitled to be enrolled for the address claimed or omitted from the roll in error; and
the declaration has been properly completed.
If the election manager is not satisfied under subregulation (2), the ballot-paper must be disallowed without opening the envelope.
