45 Preliminary scrutiny of declarations under section 110
(1)
For the purposes of section 111(2) of the Act, the election manager must conduct preliminary scrutiny of a declaration in relation to a vote cast under section 110 of the Act in accordance with this regulation.
(2)
A ballot-paper marked by an elector referred to in section 110 of the Act must be accepted for further scrutiny if the election manager is satisfied that—
(a)
the name of the elector was marked on the electoral roll in error; and
(b)
the declaration has been properly completed.
(3)
If the election manager is not satisfied under subregulation (2), the ballot-paper must be disallowed without opening the envelope.
