A representative body may bring a dispute to the Commission for dispute resolution on behalf of an unnamed person or persons if—

the dispute is in respect of a claimed contravention of a provision of Part 6A; and

the Commission is satisfied that—

each person—

is entitled to bring a dispute under section 113(1)(a); and

has consented to the dispute being brought by the body on the person's behalf; and

the representative body has a sufficient interest in the dispute as set out in section 114(2); and

if the dispute is brought on behalf of more than one person, the alleged contravention arises out of the same conduct.

The Commission may be satisfied as set out in subsection (1)(b) even if the Commission does not know the identity of the persons referred to in that provision.
