85 Legal incapacity and age of majority

(1)

Nothing in this Act is intended to affect the law in relation to the legal capacity or incapacity of any person or the age of majority.

(2)

A person may discriminate against another person if—

(a)

the other person is subject to a legal incapacity because of his or her age or disability; and

(b)

the incapacity is relevant to the transaction or activity in which they are involved.

Example

A service provider may refuse to enter into a contract with a child who, because of his or her age, does not have legal capacity to enter the contract.
