Fines Reform Act 2014

A person who buys a motor vehicle or an item under this Part acquires a good title to the vehicle or item if the person buys the vehicle or item—

in good faith; and

without notice of any defect or want of title.

The sheriff is not liable in respect of the sale of a motor vehicle or item under this Part unless it is proved that the sheriff had notice, or might by making reasonable inquiry have ascertained, that the vehicle or item was not the property of the registered operator against whom an enforcement warrant was issued.

Nothing in this section limits or affects any right or remedy the previous owner of the motor vehicle or item sold under this Part has or may bring otherwise than—

against the motor vehicle or item; or

against the sheriff in the exercise of a power of sale under this Part.
