408 Offence to remove roe from sea urchins

(1)

A person in, on or next to Victorian waters, must not remove roe or any other soft tissues from the shell of sea urchins or any other species of the class Echinoidea.

Penalty: 20 penalty units.

(2)

A person in, on or next to Victorian waters, must not possess roe or any other soft tissues which have been removed from the shell of sea urchins or any other species of the class Echinoidea.

Penalty: 20 penalty units.

(3)

This regulation does not apply to the holder of a general permit or Sea Urchin Fishery Access Licence or a person acting on behalf of that permit or licence holder who is—

(a)

authorised under the permit or licence to undertake the activities referred to in subregulations (1) and (2); and

(b)

acts in accordance with the permit or licence, the Act and these Regulations.
