39 Commissioner may deal with gender equality disputes in agreements
(1)
The Commissioner may deal with a dispute arising under an enterprise agreement or a workplace determination that covers a designated body if—
(a)
the dispute relates to a systemic gender equality issue; and
(b)
the dispute is referred to the Commissioner in accordance with a term of the enterprise agreement or workplace determination by a person covered by the enterprise agreement or workplace determination.
(2)
The Commissioner may decline to deal with the dispute if the Commissioner considers it is appropriate in the circumstances to do so.
