40 Commissioner's powers in relation to disputes
(1)
Subject to this section, the Commissioner may deal with a dispute referred under section 39 in any way the Commissioner considers appropriate.
(2)
The Commissioner must deal with a dispute independently and impartially.
(3)
The Commissioner must not deal with a dispute by arbitration.
(4)
The Commissioner cannot make any binding determination in relation to a dispute.
