46 Secrecy
Subject to section 46A, the Commissioner or a person specified in subsection (2) must not use or disclose any information obtained by or provided to the Commissioner or that person under Division 3 for any purpose other than the purpose for which it was obtained or provided.
The specified persons are—
a person referred to in section 45(1) or (2); or
a person employed under Part 3 of the Public Administration Act 2004 assisting the Commissioner in accordance with section 43; or
a person engaged to assist the Commissioner in the performance of the Commissioner's functions or duties, or the exercise of the Commissioner's powers, whether or not employed under Part 3 of the Public Administration Act 2004.
