Heritage Act 2017

The Heritage Council, with the consent of the Minister, may acquire a registered place or the land on which a registered place is situated by lease, purchase, exchange or compulsory acquisition for the purposes of protecting and conserving cultural heritage.

Subsection (1) does not apply to Crown land.

If a place is acquired under subsection (1), the Land Acquisition and Compensation Act 1986 applies to this Act and for the purposes of the acquisition—

the Heritage Act 2017 is the special Act; and

the Heritage Council is the Authority.

Any change in the market value of an interest in land arising from the inclusion of land or a place in the Heritage Register must be considered in determining compensation payable in respect of the acquisition of that interest.
